شصت و دو سال پس از ارائه اعلاميه جهانی حقوق بشر از سوی مجمع عمومی سازمان ملل متحد در سال ۱۹۴۸، و با وجود کسب دستآوردهای بزرگ در همه نقاط جهان در جهت گسترش و حفظ حقوق بشر، در شرايطی بار ديگر به استقبال دهم دسامبر، روز جهانی حقوق بشر می رویم که نه تنها با خواست اساسی «تامين همه حقوق بشر برای همه»، فاصله زيادی داریم، بل که پایه ای ترین حقوق انسانی در پاره ای ازکشورهای دنيا به فجيع ترين اشکال به طور گسترده، مستمر و برنامه ريزی شده، نقض می گردد.
یکی از این کشورها، متاسفانه ايران ماست که در اثر سيطره ناقضان حقوق بشر بر آن، مواردی از نقض حقوق بشر در آن ديده می شود که در جهان نمونه وار است:
- حق حيات از مقدم ترین حقوق بشر به شمار می رود. در حالی که بیش از دوسوم کشورهای دنيا، مجازات اعدام را در قوانين خود و يا در عمل نسخ کرده اند، جمهوری اسلامی ايران بالاترین نرخ سرانه اعدام را در دنيا دارد. میزان اعدام های اعلام شده در سال میلادی کنونی که هنوز به پایان آن نرسیده ایم، با گذر از مرز ۴۰۰ نفر بیش از موارد اعدام اعلام شده در سال گذشته است و بنا بر خبرهایی که از اعدام های مخفی زندان مشهد رسیده است، (هفته ای ۷۰ اعدام در چند هفته) چه بسا که به مرز ۷۰۰ نفر رسیده باشد. در قوانین کیفری ايران برای 33 مورد جرم مجازات اعدام در نظر گرفته شد و اعدام در ايران همراه با شکنجه جسمی و روانی، يعنی «زجرکشی» است.
- مجازات اعدام در ايران عمدتا از طریق طناب دار و با بالا کشیدن توسط جرثقیل یا خالی کردن زير پا از فاصله کوتاه و با طناب کوتاه است. جان دادن محکوم به اعدام به این ترتیب، چند دقیقه طول می کشد و قطعا برای ما قابل تصور هم نمی تواند باشد که میزان زجر کسی که با چشمان از حدقه در آمده به سوی مرگ می رود در چه حد می تواند باشد.
- علاوه بر این زجرکشی "معمول"، در قانون مجازات اسلامی که از دهه ها پیش اجرا می شود، سنگسار، صليب کردن و پرتاب از بلندی، نيز پیش بینی شده است. چندین نفر در سال های گذشته قربانی مجازات سنگسار شده اند و هم اکنون ۱۳ نفر حکم سنگسار گرفته اند که شاخص ترین آنان، خانم سکینه محمدی آشتیانی است. دستگاه قضایی هيچ حکومت ديگری در دنيا حکم سنگسار صادر نمی کند.
- بنا بر مفاد ميثاق حقوق سياسی و مدنی و کنوانسيون حقوق کودک، صدور مجازات اعدام برای کسانی که در سنين کمتر از ۱۸ سال مرتکب جرمی شده باشند، غير قانونی است. هر دو سند یادشده به تصويب قوه قانونگذاری ايران رسیده است و جمهوری اسلامی موظف به رعايت مفاد آن است. با اين همه، اعدام نوجوانان به طور مستمر در ايران صورت می گيرد و ده ها نوجوان در هراس از رسیدن به سن ۱۸ سالگی و اعدام، گذر هر روز برایشان با شکنجه توام است. در سال های اخير، عربستان سعودی و یمن، گاه به اعدام نوجوانان دست زده اند. اما در مورد جمهوری اسلامی اين امر مستمر بوده است و در همه سال های اخير روی داده است.
- اعدام در ملاء عام، در هیچ کجای ديگر دنیا به جز ايران صورت نمی گیرد. این شیوه اعدام، علاوه بر آنکه شکنجه مضاعفی بر محکوم به اعدام است، بر سلامت روانی شاهدان اين "نمايش" به خصوص کودکان تاثیر می گذارد و خاطره وحشتناک آن هرگز از اذهان زدوده نمی شود.
- قطع اندام ها (دست، پا، چشم و ......) به عنوان مجازات، اکنون در دنيا تنها در سیستم حقوقی جمهوری اسلامی و عربستان سعودی، صورت می گیرد. هرساله مواردی از صدور و اجرای این احکام در ايران گزارش می شود. این در حالی است که از سوی ديگر جمهوری اسلامی، کنوانسیون بین المللی «حقوق افراد دارای معلوليت» را تصویب کرده است که بنا بر آن، شرايط و امکانات افراد معلول بايد هر چه بیشتر به افراد ديگر نزدیک گردد. سیستم حقوقی جمهوری اسلامی علاوه بر شکنجه روانی و بدنی قطع عضو، از این طریق معلولان جدیدی را به جمع کثير آسیب ديدگان جنگ و سوانح بیش از معمول حین کار و رانندگی می افزاید.
جدا از موارد پیش گفته به شدت نادر در عرصه بين المللی، شاید موردی از حقوق تضمین شده بشری در اعلاميه جهانی حقوق بشر و دو ميثاق جامع مرتبط با آن و کنوانسيون های عديده حقوق بشری نباشد که توسط جمهوری اسلامی ايران نقض نگردد.
در حوزه حقوق زنان، جمهوری اسلامی با وضع قوانین تبعیض آمیز راه را برای خشونت بیشتر علیه زنان به شمول، قتل های ناموسی و ارجگذاری کمتر به زنان در عرصه های متفاوت باز کرده که از جمله از قوانین و بخشنامه های محدودکننده تحصیل زنان و تصویب "لایحه حمایت ازخانواده" ای است که در جهت تسهیل چند همسری می باشد، می توان نام برد. جمهوری اسلامی در کنار سودان و سومالی و سه کشور بسیار کوچک اقيانوس آرام، از جمله معدود کشورهایی است که به کنوانسیون رفع تمام اشکال تبعيض علیه زنان نپیوسته است.
افراد متعلق به گروه های اتنيک مختلف، کماکان در مراحل مختلف زندگی مورد اجحاف و تبعيض قرار می گیرند. مفاد اعلاميه مربوط به حقوق اشخاص متعلق به اقلیت های ملی يا قومی، دينی و زبانی مصوب مجمع عمومی سازمان ملل متحد در سال ۱۹۹۲ در قوانين و مناسبات حکومت و این بخش از مردم ايران بازتاب نيافته است.
اقلیت های مذهبی، به ويژه بهاییان و نوکیشان مسیحی که دينشان يا تغيير دينشان به رسميت شناخته نمی شود، در معرض شدیدترین موارد نقض حقوق بشر قرار دارند و به گاه با انتساب جرائمی چون جاسوسی و ارتداد در معرض خطر مرگ قرار می گيرند.
دگرباشان جنسی،نيز از ديگر اقليت های اجتماعی کشور ما هستند که حقوق انسانی شان نقض می گردد. قریب ۳۰ ماده قانون مجازات اسلامی به «لواط» و «مساحقه» اختصاص داده شده است که دگرباشان جنسی را با خطر مرگ مواجه می کند.
دهم دسامبر، روز جهانی حقوق بشر، امسال به «مدافعان حقوق بشر که برای رفع تبعيض» مبارزه می کنند، اختصاص يافته است. صدها مدافع حقوق بشر، که تنها برای رفع تبعیضات عديده و تامين حقوق مردم کشورمان مبارزه کرده اند، اکنون در زندان های جمهوری اسلامی، زير شديدترین شکنجه های جسمی و روانی اند.
ما تلاش برای آزادی آنان را مقدم ترین وظیفه مشترک خود می دانیم تا آنان آزادانه به آموزش و گسترش حقوق بشر در جامعه بپردازند. مصوبه مجمع عمومی سازمان ملل متحد در سال ۱۹۹۸ ميلادی، مشهور به «اعلاميه مدافعان حقوق بشر» که بدون رای گیری به تصویب رسیده است، از جمله جمهوری اسلامی را موظف می کند که به مفاد آن احترام بگذارد و زمينه آزادی تحرک مدافعان حقوق بشر را فراهم کند.
کمیته سوم مجمع عمومی سازمان ملل متحد چند هفته پیش برای هشتمین سال، قطعنامه ای در محکوميت نقض حقوق بشر در جمهوری اسلامی صادر کرد و برای نخستین بار از دبیرکل سازمان ملل متحد خواست که گزارش خود را در مورد وضعيت حقوق بشر به جلسه شورای حقوق بشر که در ماه مارس ۲۰۱۱ برگزار خواهد شد، ارائه دهد. به این ترتیب، شورای حقوق بشر علاوه بر روند معمول بررسی ادواری جهانی که هر کشور را هر چهار سال مورد بررسی قرار می دهد، به وضعيت حقوق بشر در ايران، به طور ويژه نيز خواهد پرداخت.
حضور جامعه مدنی ايرانی در داخل و خارج از کشور در کارزار افشای موارد نقض حقوق بشر در جمهوری اسلامی و روشنگری اذهان مردم جهان در این ارتباط، عرصه را بر ناقضان حقوق بشر در ايران تنگ تر خواهد کرد.
ما به سهم خود می کوشیم که این کارزار را گسترش دهیم

Sixty two years have passed since the Universal Declaration of Human Rights was proclaimed by the United Nations.
Unfortunately, as we are presently honouring the occasion, in many counries of the world, Human Right (HR) are severly violated in a systematic and premediated manner.
And again unfortunately, a horrifying example of this situation is the case of Iran,our primary homeland, where unprecedented HRs violations and abuse are on the daily agenda, in a broad scope and a brutal manner.
Yet, Iranians claim to include the first author of any HRr declaration in their history. This refers to the Cylinder of Cyrus the Great, the Achamenide King, displayed on the ground floor of the British Museum in London. The Inscription was issued when Cyrus freed jewish prisoners subjected to arbitrary rule, in Babylon of the ancient days.
* the first such declaration was. However, in todays Iran most cruel forms of torture as well as capital punishment are carried out, on a daily basis.
In our days, when two third of all countries have abolished death penalty by their law, or stopped practicing this form of punishment, Iran registers the highest rate in capital punishment. During the current year, so far, the number of executions in Iran hhave exceed those of last year and 400 cases. It is likely, that the real numbers are much higher . In Meshed* the north earstern provincial capital, resports say that each week about 70 prisoners are secretly executed. Theses numbesr,when added to 400 known cases, would correct the total numbers of capital punishment cases to 700 this year, only.
* Execution in Iran is not an instant killings of the individual. It is the final act of a prolongued torture of the person. Death must be experienced bz the victim as a long process of humilation and exorbitant physical suffering. This still does not include a hint to stoning. Out of thirteen cases in the row of conviction to death by stoning, the case of Sakineh Ashtiani occupies a particular place, due to the international media attention it has received. Other cruel forms are death by throwing the victim from high altitude or even crucifying the victim. Execution take place,as a rule, in public sites. The traumatic effect of such exercise on wittnesses, particularly on young adults, is obvious . It has a considerable perpetuating effect on keeping the level of violence high, in the society.
* Execution of juvenile deliquents inspite of the fact that Iran is a signatary of the UN Convention on the Right of Children. Alleged juvenile deliquents are held in prison until they reach the age of maturity. This is 18 years. Once considered adults, they are+ legally+ subjected to capital punishment for the alledged crime that they are supposed to have performed as a child.
* Another sever form of violation of HRs , the humanitarian cultutre as well as violation of the international treatees to which Iran has committed itself, is the practice of amputation, hands, legs and even eyes sometime, as a means of punishment. This medival form of punishment for thefts and other forms of crimes, not only must be condamned in the 21st century. At the same time it increases the number of Iran|s already existing disabled citizens, produced by the unfortunate 8 years of Irak/Iran war.
* It goes without saying that the violation of HR does not limit itself to above practices . It practicallz does not leave out any aspect of peoples daily lives in Iran. Those supressed rights include very personal issues and choices. Examples are numerous, all aspects of rights of iranian women, basic rights of iranian ethnic minorities and political opponents, basic human rights of students and workers, those of mystics, Sufis and religios minorities, to name but a few .
* December 10th, International Day of UNIVERSAL Human Rights, this year, is dedicated to the work of human rights defenders all over the world.
* In Iran today, hundrets of activists of different paths are under theat and torure, be it physically or psychologicalle respkively emotionally.
* Actually Iran should be expected to respect the 1998 Resolution of the UN Generalassembly that was passed unanimously. The Resolution explicitly honours all human rights defenders. If Iran would commit to the resolution, it would have to stop the imprisonment and torture practices of its democratic and active citizens.
* The presence of diaspora activist, worldwide, will certailnly have an impact on the information level to the world on the numerous human rights violations in Iran. It will help tighten the circle of violent actions there and shame the authorities in todays Iran.
* We, undersigned organizations, based in Vienna, conseider ourselves part of this worldwide movement. We head to achive the implemenation of the Universal Declaraition of Human Rights, in Iran. We will continue this crucial task in future. We wish to reach out to likeminded persons and get support of all of you, who believ and respect Human Rights for all . The public opinion of democratic countries across the world, are our allies.

UNGETEILTE MENSCHENRECHTE FÜR ALLE
Seit der Verkündung der Allgemeinen Erklärung der Menschenrechte im Jahre 1948 sind 62 Jahre vergangen. Bedauernswerterweise passieren in einigen Ländern immer noch gravierende und systematische Übertretungen dieser Grundrechte.
Zu diesen Ländern gehört bedauernswerter Weise unsere Erstheimat Iran.
Bei den Iranern erfreut sich eine Sage großer Beliebtheit, nach der ein iranischer König vor über zweitausend Jahren - mittels eines im besiegten Babylon verkündeten Dekret - Andersgläubigen und vor allem Juden ihre Menschenrechte zugebilligt hat (in der Zeit der Achameniden unter König Cyrus dem Großen). Damit wurde ein erster Schritt in diese Richtung gesetzt. Heute jedoch ist die Menscherechtsituation im Iran mit keinem anderen Land der Welt vergleichbar :
-Das Recht auf Leben: In einer Zeit, in der etwa zwei Drittel aller Länder die Todesstrafe als Strafform entweder abgeschafft haben oder nicht durchführen, weist die Islamische Republik Iran (IRI) die höchste Exekutionsrate auf .
Im noch laufenden Jahr 2010 erreicht die Anzahl der Hinrichtungen mit bisher 400 Fällen ein noch höheres Niveau als im Vorjahr.
Zuverlässige Quellen berichten, daß in letzter Zeit beispielsweise in der Stadt Mashad durchschnittlich 70 Geheimhinrichtungen pro Woche - ohne Gerichtsverfahren - stattfinden. Es wird beichtet, dass Schätzungsweise in den letzten Monate an die 700 Exekutionen stattgefunden haben. Im iranischen Strafrecht sind 33 Straftatbestände gelistet, die mit dieser Strafform geahndet werden. In der Regel finden die Hinrichtungen auf gewaltsame und brutale Art statt.
Die Todesstrafe ist ein Tod mit Qualen. Weitere Hinrichtungsformen wie Steinigung, Kreuzigung und Wurf aus großer Höhe sind in der IRI gang und gäbe.
Zur Zeit warten dreizehn Verurteilte auf die Vollstreckung ihrer Steinigung, die jederzeit ohne Verständigung von Anwälten und Angehörigen erfolgen kann. Der bekannteste Fall betrifft Sakineh Mohammadi Aschtiyani.
- Laut internationalen Konventionen und Protokollen (beispielsweise der Internationalen Konvention des Kinderrechts) ist die Todesstrafe bei Delinquenten unter 18 Jahren nicht zulässig. Obwohl diese Vereinbarung auch vom Iran ratifiziert wurde, werden regelmäßig jugendliche Straffällige hingerichtet. Viele jugendliche Häftlinge fürchten auch das Erreichen des 18. Lebensjahres, da sie ab dann exekutiert werden können. Die Zeit des Wartens macht die Haftstrafe für die Jugendlichen zur täglichen psychischen Folter. Ihre Volljährigkeit bedeutet das Ende ihres jungen Lebens.
- Öffentliche Hinrichtungen werden offenbar in der Absicht vorgenommen, der Bevölkerung eine „Lehre“ zu erteilen.
- Obwohl die IRI die Konvention der Rechte von Behinderten unterzeichnet hat, werden Menschen durch Amputation von Gliedmaßen (Handabschlag bei Diebstahl, Beinamputation und Entfernung des Auges) bestraft. Diese vormittelalterliche und extrem menschenverachtende Strafform ist auf Schärfste abzulehnen.
Auch darüberhinaus werden Menschenrechte in der IRI kaum respektiert. Besonders hervorzuheben sind hier Frauenrechte, Rechte ethnischer und religiöser Minderheiten sowie anderer Minderheiten wie zum Beispiel Homosexueller. Diese Gruppen sind Opfer regelmäßiger und systematischer Menschenrechtsverletzungen. Der Iran hat im Laufe der Zeit viele Konventionen und internationale Verträge ratifiziert und sie offiziell niemals widerrufen. Trotzdem werden sie ständig und willkürlich verletzt.
Heuer ist der Tag der Menschenrechte, der 10.Dezember 2010, dessen Verteidigern gewidmet, die sich für die Beseitigung von Diskriminierungen einsetzen. Hunderte von Personen, die sich für Menschenrechte eingesetzt haben, bevölkern heute die Gefängnisse der IRI und sind schlimmster psychischer und physischer Folter ausgesetzt.
Unsere erste Priorität lautet, diese Menschen freizubekommen. Ihre Freiheit ermöglicht, daß der Weg der iranischen Gesellschaft in Richtung Demokratie- und Menschenrechtswerte fortgesetzt werden kann.
Die UNO-Resolution von 1998, bekannt als „Deklaration der Verteidiger der Menschenrechte“, wurde ohne abzustimmen angenommen. Sie verpflichtet die IRI, die Bewegungsfreiheit von Menschenrechtsaktivisten zu garantieren.
Die Dritte Kommission der Vereinten Nationen hat vor wenigen Wochen eine Resolution verfasst, in der die aktuellen Menschenrechtsverletzungen der IRI verurteilt werden. Zum ersten Mal fordert die Kommission den UN-Generalsekretär auf, bei der nächsten Versammlung des Menschenrechtsrates im März 2011 einen Bericht über die Lage der Menschenrechte im Iran vorzulegen.
Die Präsenz der iranischen Zivilgesellschaft, vor Ort wie auch im Ausland, hat einen wichtigen Einfluß auf die Entwicklung der Situation in Iran. Informationen über die ständigen Menschenrechtsverletzungen werden an die Weltöffentlichkeit gebracht. Die Unterstützung dieser Öffentlichkeit ist von tragender Bedeutung und kann helfen, Ausmaß und Qualität dieser Verletzungen zu reduzieren.
Unterfertigte Menschenrechtsorganisationen verstehen sich als Teil dieser weltweiten Bemühungen, die sich für ein Ende der schweren Menschenrechtverletzungen im Iran einsetzen.

LES DROITS DE L’HOMME SONT INDIVISIBLES POUR TOUS
62 ans ont passÈ depuis la Declaration des Droits d' Homme en 1948. Malheureusement, ces droits sont actuellement toujours viole' dans certains pays.
Regrettablement, notre premiËre patrie, l’Iran, fait partie de ces derniers.
Il y plus de deux mille annÈes que le roi perse cyrus a accordÈ les droits de l’homme aux personnes d’une autre foi, particuliËrement aux juifs. C’Ètait une premiËre Ètape dans la bonne direction. NÈanmoins, la situation actuelle des droits de l’homme en Iran n’est pas comparable ‡ d’autres pays:
-Le droit de vivre: La rÈpublique islamique d’Iran (IRI) fait preuve du taux d’Èxecutions le plus ÈlevÈ au monde, dans une pÈriode o_ presque deux tiers de tous les pays ont abolis oubien n’exÈcutent plus la peine de mort.
En 2010, le nombre d’exÈcutions (400) atteindra un niveau encore plus ÈlevÈ que l’annÈe prÈcÈdente.
Des sources fiables nous parlent par exemple d’environ 70 exÈcutions secrËtes par semaine dans la ville de Machad - sans aucune action judiciaire.
Le droit pÈnal iranien Èvoque 33 infractions qui peuvent Ítre sanctionnÈs par la peine de mort. GÈnÈralement, les exÈcutions sont effectuÈes d’une maniËre violente voir brutale.
La peine de mort en Iran est une mort ‡ souffrance. D’autres techniques d’exÈcution comme la lapidation ou la crucifixion sont ‡ l’ordre du jour dans l’IRI.
Treize condamnÈs attendent actuellement leur exÈcution par la lapidation, qui aura lieu sans consulter les avocats ou les familles. Le cas le plus connu concerne Madame Saquineh Mohammadi Achtiyani.
- D’aprËs des conventions et protocols internationaux (comme par exemple la convention internationale des droits des enfants), la peine de mort n’est pas applicable aux moins de 18 ans. Bien que l’IRI ait ratifiÈ cet accord, des personnes mineures sont rÈguliËrement exÈcutÈes. De nombreux dÈlinquents juvÈniles craignent le jour de leur 18Ëme anniversaire, sachant que la majoritÈ signifie pour eux la fin de leur vie.
- Il existe des exÈcutions publiques, apparemment faites pour donner une leÁon ‡ la population.
- Bien que l’IRI ait ratifiÈ la convention des droits des handicapÈs, l’Ètat punit des gens par l’amputation d’extrÈmitÈs.
En outre, les droits de l’homme ne sont quasiment pas respectÈs dans l’IRI, en particulier les droits des femmes, de minoritÈs ethniques et religieuses, et les droits des homosexuels. Ces groupes sont rÈguliËrement victimes de violations systÈmatiques de leurs droits. L’IRI a ratifiÈ nombreuses conventions au cours des annÈes, et ne les a jamais officiellement rÈvoquÈes. Pourtant, ces conventions sont reguliËrement violÈes d’une maniËre arbitraire.
La journÈe des droits de l’homme, aujourd’hui, le 10 dÈcembre 2010, est dÈdiÈe ‡ celles et ceux qui dÈfendent ces droits, qui s’investissent pour l’abolition de discriminations. Des centaines de personnes qui luttent pour les droits de l’homme peuplent aujourd’hui les prisons de L’IRI et sont victimes de torture physique et mentale.
Notre premiËre prioritÈ consiste ‡ libÈrer ces personnes. Leur libÈration est une condition de base pour suivre le chemin vers la dÈmocratie et les valeurs humaines dans la societÈ iranienne.
La rÈsolution de l’ONU de 1998, connue sous „dÈclaration des dÈfendeurs des droits de l’homme“, engage l’IRI ‡ garantir la libertÈ de mouvement des activistes des droits de l’homme.
La troisiËme commission des Nations Unies a rÈdigÈ il y a quelques semaines une rÈsolution qui condamne les violations actuelles des droits de l’homme. Pour la premiËre fois, la commission convie le secrÈtaire gÈnÈral ‡ soumettre un rapport ‡ propos de la situation des droits de l’homme en Iran.
La prÈsence de la sociÈtÈ civile iranienne, en Iran comme ailleurs, a une influence majeure sur le dÈveloppement de la situation en Iran. Des informations sur les violations des droits de l’homme sont rendues accessibles ‡ l’opinion publique internationale. Le soutien de cette publicitÈ est d’une grand importance et peut contribuer ‡ rÈduire l’ampleur et la qualitÈ de ces violations.
