احسان فتاحيان زندانی سياسی كرد كه طي يك روند كاملا غير قانوني صبح امروز اعدام شد ، دو روز پيش از اعدام طی رنجنامه ای وضعيت خود را چنين شرح ميدهد. در زير متن فارسي و ترجمه انگليسي اين رنجنامه را ميخوانيد:
واپسين شعاع آفتاب شبانگاهی
نشان دهنده ی راهی ست که خواهان در نوشتن آنم
خش خش برگ ها زير قدم هايم
ميگويد : بگذار تا فرو افتی
آنگاه راه آزادی را باز خواهی يافت
هرگز از مرگ نهراسيده ام , حتی اکنون که آن را در قريب ترين فضا و صميمانه ترين زمان , در کنار خويش حس ميکنم. آن را ميبويم و بازش ميشناسم , چراکه آشنايی ست ديرينه به اين ملت و سرزمين. نه با مرگ که با دلايل مرگ سر صحبت دارم , اکنون که " تاوان " دگرديسی يافته و به طلب حق و آزادی ترجمه اش نموده اند , آيا ميتوان باکی از عاقبت و سرانجام داشت؟ " ما " ای که از سوی "آنان " به مرگ محکوم شده ايم در طلب يافتن روزنه ای به سوی يک جهان بهتر و عاری از حق کشی در تلاش بوده ايم , آيا آنان نيز به کرده ی خود واقف اند؟
در شهر کرمانشاه زندگی را آغاز کردم , آنجا که بزرگيش ورد زبان هم ميهنانم است , آنجايی که مهد تمدن ميهنم بوده است. قطور ذهن ام بدان سويم کشيد که تبعيضی را و وضعيتی ناروا را بفهمم و از اعماق وجود درکش نمايم که گويای ستم بود , ستمی در حق من چنان فردی انسانی و در حق من چنان مجموعه ای انسانی , پيگيری چرايی ستم و رفع آن به هزاران فکرم راهبر شد , اما وااسفا که آنان چنان فضا را مسدود و حق طلبی را محجور و سرکوب کرده بودند که در داخل راهی نيافتم و ورای محدوده های تصنعی به مکانی ديگر و مامنی ديگر کوچيدم : " من پيشمرگه ی کومله شدم " , سودای يافتن خويش و هويتی که از آن محروم شده ام من را بدان سو کشاند. دور شدن از خواستگاه کودکی هرچند آزاردهنده و سخت بود اما هيچ گاه باعث انقطاع من از زادگاهم نشد. هراز گاهی به قصد تجديد ديدار و بازيابی خاطرات روانه ی خانه ی نخستين ميگشتم , اما يک بار " آنان " ديدار را به کامم تلخ کردند , دستگيرم کردند و به قفسم انداختند. از همان آغاز و با پذيرايی انسان دوستانه ی دستگير کنندگانم !! فهميدم که همان سرنوشت تراژديک و غمناک همراهان و رهروان اين راه پررهرو به انتظار نشسته است : شکنجه , پرونده سازی , دادگاه سرسپرده و شديدا تحت نفوذ , حکمی کاملا ناعادلانه و سياسی , و در نهايت مرگ......
بگذاريد خودمانی تر بگويم : پس از دستگيری در شهر کامياران به تاريخ ۲۹/۴/۸۷ و پس از چند ساعت مهمان بودن در اداره ی اطلاعات آن شهر , در حالی که دستبند و چشمبندی قطور حرکت و ديدن را برايم ممنوع نموده بود , فردی که خود را معاون دادستان معرفی ميکرد شروع به طرح يک سری پرسش بی ربط و مملو از اتهامات واهی نمود (لازم به ذکر است که هرگونه بازپرسی قضايی در محيطی غير از محيط دادسرا و دادگاه طبق قانون مطلقا ممنوع است). بدين ترتيب اولين دور بازجويی های عديده ام کليد خورد. همان شب به اداره ی اطلاعات استان کردستان در شهر سنندج منتقل شدم و سور واقعی را آنجا تجربه نمودند : سلولی کثيف با دستشويی نامطبوع و پتوهايی که احتمالا ده ها سال از ملاقاتشان با آب و پاکيزگی ميگذشت! . از آن به بعد شب و روز دالان پايينی و اتاق های بازجويی با چاشنی کتک و شکنجه ی طاقت فرسا , به تسلسلی پايان ناپذير و سه ماهه تبديل شد. بازجويان محترم در جهت ارتقای منزلت شغلی خويش و در سودای چند پشيزی ناچيز و بی ارزش , در اين سه ماه به طرح اتهاماتی عجيب و غريب ميپرداختند که خود بهتر از هرکس به کذب بودن آنها ايمان داشتند. علی رغم آزمودن تمامی روش ها و در عملياتی مسلحانه شرکت نموده بودم , اتهاماتی که در بسيار در اثبات آن کوشيدند. تنها موارد اثباتی عضويت در کومله و تبليغ عليه نظام بود که بهترين گواه در يگانه بودن اتهامات رای دادگاه بدوی است , شعبه ی اول دادگاه انقلاب اسلامی سنندج حکم به ۱۰ سال حبس توام با تبعيد به زندان رامهرمز داد. ساختار اداری و سياسی ايران هميشه دچار آفت تمرکز گرايی بوده است اما در اين يکی نمونه که به ظاهر قصد تمرکز زدايی از امر قضا را داشتند. به تازگی اختيار و صلاحيت تجديد نظر در احکام متهمين سياسی را در بالاترين سطح – حتی اعدام – از ديوان عالی گرفته و به محاکم تجديد نظر استان سپرده اند , با اعتراض دادستان کامياران به حکم بدوی و در نهايت تعجب و برخلاف قوانين موضوعه و داخلی خود ايران , شعبه ی چهارم دادگاه تجديد نظر استان کوردستان حکم ۱۰ سال زندان را به اعدام تبديل نمود. بر پايه ی ماده ۲۵۸ قانون آيين دادرسی کيفری محاکم تجديد نظر تنها در صورتی مجاز به تشديد حکم بدوی ميباشند که حکم صادره از حداقل مجازات مقرر در قانون کمتر باشد. بر طبق کيفر خواست دادستان ئ اتهام وارده _ يعنی محاربه(دشمنی با خدا) – حداقل حکم در اين مورد يک سال است حال خود فاصله ی ۱۰ سال توام با تبعيد را با اين حداقل مقايسه کنيدتا پی به غير قانونی, غير حقوقی و سياسی بودن حکم اعدام ببريد.
البته ناگفته نماند که مدتی کوتاه پيش از تبديل حکم, مجددا" از زندان مرکزی سنندج به بازداشتگاه اداره اطلاعات منتقل و در آنجا از من خواسته شد طی يک مصاحبه ويديوئی به اعمالی ناکرده اقرار و کلمات و جملاتی در رد افکار خويش برزبان آورم . علی رغم فشارها ی شديد, من حاضر به قبول خواسته نامشروع آنان نشدم و آنها نيز صراحتا" گفتند حکمم را به اعدام تبديل خواهند نمود, که خيلی زود به عهد خويش وفا کردن و سرسپردگی دادگاه را به مراجع امنيتی و غير قضايی اثبات نمودن. پس آيا انسان می تواند بر آنان خرده ای بگيرد؟!
قاضی سوگند خورده که همه جا, در هر زمان و در قبال هر فرد و موضوعی بی طرف مانده و صرفا" از دريچه ی حقوق و قانون به جهان بنگرد, که امين قاضی اين سرزمين به قهقرا رفته می تواند ادعا نمايد که سوگند را نشکسته و بی طرف و عادل باقی مانده است؟ به زعم بنده چنين قضاتی به تعداد انگشتان يک دست هم نمی رسند. هنگامی که کل سيستم های قضايی ايران به اشاره يک بازجوی بی دانش و عاری از هرگونه سواد حقوقی , دستور بازداشت, محاکمه, محبوس نمودن و مرگ افراد را اجرا می نمايد, آيا می توان بر يک يا چند قاضی خرده پای يک استان هميشه تحت ستم و تبعيض خرده گرفت؟ آری, خانه از پای بست ويران است......
حال علی رغم اين که در آخرين ملاقاتم در داخل زندان با دادستان صادر کننده کيفر خواست, وی به غير قانونی بودن اجرای حکم در هنگامه ی اکنون اذعان داشت, اما برای دومين بار قصد اجرای حکم را دارند. نا گفته پيداست که اينچنين پافشاری کردن بر اجرای حکم به هر نحو ممکن , نتيجه ی فشارهای محافل امنيتی و سياسی خارج از قوه ی قضائيه است . افراد عضو اين محافل تنها از زاويه ی فيش حقوقی و اغراض و نيات سياسی خويش به موضوع مرگ و زندگييک زندانی سياسی می نگرند, برای آنان ورای اهداف غير مشروع خويش هيچگونه " مسئله " ای قابل طرح و تصور نيست, حتی اگر اولين حق همزاد بشر يعنی حق حيات باشد. اسناد جهانی و بين المللی پيشکش, آنان حتی قوانين و الزامات داخلی خود را نيز هيچ و بيهوده می انگارند.
اما سخن آخر: اگر به گمان زورورزان و حاکمان, مرگ من موجب حذف مسئله ای به نام مسئله کردستان خواهد شد بايد گفت زهی خيال باطل . نه مردن من و نه هزاران چون من مرهمی بر اين درد بی درمان نخواهد بود و چه بسا آتش آنرا شعله ورتر خواهد نمود. بی گمان " هر مرگ اشارتی است به حياتی ديگر".

Ehsan Fattahian (Political prisoner about to be Executed): "Last Statement to people"
Last ray of sun at sunset/
is the path that I want to write on/
The sound of leaves under my feet/
say to me: Let yourself fall/
and only then you find the path to freedom./
I have never been afraid of death, even now that I feel it closest to me. I can sense it and I'm familiar with it, for it is an old acquaintance of this land and this people. I'm not writing about death but about justifications for death, now that they have translated it to restoring justice and freedom, can one be afraid of future and destiny? "We" who have been sentenced to death by "them," were working to find a small opening to a better world, free of injustice, are "they" also aware of what they are working towards?
I started life in city of Kermanshah, the city that my country people consider grand, the birthplace of civilization in our country. I soon noticed descrimination and oppression and I felt it in the depth of my existence, this cruelty, and the "why" of this cruelty and trying to resolve it made me come up with thousands of thoughts. But alas, they had blocked all the roads to justice and made the atmosphere so repressive that I didn't find any way to change things inside, and I migrated to another resort: "I became the pishmarg of Koomaleh," the temptation to find myself and the identity that I was deprived of made me go in that direction. Although leaving my birthplace was difficult but it never made me cut ties with my childhood hometown. Every now and then I would go back to my first home to revisit my old memories, and one of these times "they" made my visit sour, arrested and imprisoned me. From that first moment and from the hospitality (!!) of my jailers I realized that the tragic destiny of my numerous compeers also awaits me: torture, file building, closed and seriously influenced court, an unjust and politically charged verdict, and finally death...
Let me say it more casually: after getting arrested in town of Kamyaran on 29/4/87 and after a few hours of being a "guest" at the information office of that town, while handcuffs and a blindfold took away my right to see and move, a person who introduced himself as a deputy of the prosecutor started asking a series of unrelated questions that were full of false accusations (I should point out that any judicial questioning outside of courtroom is prohibited in the law). This was the first of my numerous interrogation sessions. The same night I was moved to the information office of Kurdestan province in city of Sanandaj, and I experienced the real party there: a dirty cell with an unpleasant toilet with blankets that had probably not seen water in decades! From that moment my nights and days passed in the interrogation offices and lower hallway under extreme torture and beatings and this lasted three months. In these three months my interrogators, probably in pursuit of a promotion or some small raise, came up with strange and false accusations against me, which they better than anyone knew how far from reality they were. They tried very hard to prove that I was involved with an armed attempt to overthrow the regime. The only charges they could pursue was being a part of "Koomaleh" and advertising against the regime. The first "shobe" of Islamic republic court in Sanandaj found me guilty of these charges and gave me 10 years sentence in exile in Ramhormoz prison. The government's political and bureaucratic structure always suffers from being centralized, but in this case they tried to de-centralize the judiciary and gave the powers to re-investigate (appeal?) the crimes of political prisoners, even as high as death penalties, to the appeal courts in Kurdestan province. In this case the prosecutor Mr. Kamyaran appealed the verdict by the first court and the Kurdestan appeals court changed my verdict from 10 years in prison to death sentence, against the Islamic republic laws. According to section 258 of “Dadrasi Keyfari” law, an appeals court can increase the initial verdict only in the case that the initial verdict was less than minimum punishment for the crime. In my case, the crime was “Moharebeh” (animosity with God), which has the minimum punishment of one year sentence, and my verdict was a 10 year sentence in exile, clearly above the minimum. Compare my sentence to the minimum sentence for this crime to understand the unlawful and political nature of my death sentence. Although I also have to mention that shortly before changing the verdict they transferred me from the main prison in Sanandaj to the interrogation office of the Information Department and requested that I do a video interview confessing to crimes I have not committed, and say things that I do not believe in. In spite of a lot of pressure I did not agree to do the video confession and they told me bluntly that they will change my verdict to death sentence, which they shortly did, and demonstrated how the courts follow forces outside of judiciary department. So should they be blamed??
A judge has been sworn to stay fair in every situation, at all times and towards every person and look at the world from the legal perspective. Which judge in this doomed land can claim to has not broken this swear and has stayed fair and just? In my opinion the number of such judges is less than fingers on one hand. When the whole judicial system of Iran with the suggestion of an interrogator (with no knowledge of legal matters), arrests, tries, imprisons and executes people, can we really blame the few judges of a province which is always repressed and discriminated against? Yes, this house is ruined from its foundations...
This is in spite of the fact that in my last visit with my prosecutor he admitted that the death sentence is unlawful, but for the second time they gave me the notice for carrying out the execution. Needless to say that this insistence on carrying a death sentence under any circumstance is the result of pressure from security and political forces from outside of the judiciary department. Said people look at life and death of political prisoners only from the point of view of their paychecks and political needs, nothing else matters to them other than their own goals, even if it is about the most fundamental right of other human beings, their right to live. Forget international laws, they completely disregard even their own laws and procedures.
But my last words: If in the minds of these rulers and oppressors my death will get rid of the “problem” called Kurdestan [the province], I should say, what an illusion. Neither my death nor the death of thousands like me will be remedy to this incurable pain and perhaps would even fuel this fire. Without a doubt, every death points to a new life.
